These Terms and Conditions govern the use of the "Music Pocket" application, developed by Estroverso Srl, and of all related services.

By using Music Pocket you confirm that you have read and accepted these Terms. If you do not accept them, please do not use the application.

1. Scope and acceptance of the Terms:

These Terms form an agreement between you and Estroverso Srl and govern access to and use of the Music Pocket application, its website and every related feature.

Acceptance takes place when you create an account or, failing that, the first time you use the application.

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

2. The service:

Music Pocket lets you build a personal music library: save artists and albums, give ratings, write notes on tracks, follow other people, comment and discover new music.

Catalogue information — artists, albums, tracks, cover art and images — comes from public third-party sources, including MusicBrainz, Wikidata and the Cover Art Archive, and may be incomplete, inaccurate or out of date.

Music Pocket does not host, play or distribute music recordings. Where available, links to third-party streaming services are shown; their use is subject to the terms of those services.

3. Account and access:

Using the application requires creating an account, which can also be done by signing in with Google.

You are responsible for keeping your credentials confidential and for any activity carried out with your account.

You undertake to provide truthful information and to keep it up to date.

If your account is used without your authorisation, you must inform us promptly at musicpocket@estroverso.com.

4. Minimum age:

Music Pocket may be used only by people aged 16 or over.

Younger users may use the application only with the consent and under the supervision of a parent or legal guardian, within the limits set by the law of their own country.

5. Rules of use:

When using Music Pocket you undertake not to:

Publish unlawful, defamatory, offensive, discriminatory or harassing content, or content that infringes the rights of others.

Impersonate other people or falsely state a connection with anyone.

Send spam, unsolicited advertising or repetitive content.

Attempt to access restricted areas or data, circumvent security measures or overload our systems.

Extract the contents of the application by automated means, or decompile or modify the software, except within the limits allowed by law.

Use the service for purposes other than personal, non-commercial ones.

6. User-generated content:

Ratings, notes, comments, your nickname and the images you upload remain yours, and you are solely responsible for them.

By publishing them you grant Estroverso Srl a free, non-exclusive licence, limited to what is necessary to display and store them within the service; the licence ends when the content or the account is removed, except for the technical copies described on the account deletion page.

Content that breaches these Terms may be removed. Any user can report it from within the application.

We do not carry out systematic prior screening of content published by users.

7. Third-party content and intellectual property:

The software, brand, graphics and texts of Music Pocket belong to Estroverso Srl.

Catalogue data comes from third-party sources and remains subject to their respective licences and conditions; cover art, photographs and trade marks belong to their respective owners and are shown for identification purposes.

Anyone who believes that content in the application infringes their rights can write to musicpocket@estroverso.com: the report will be examined and, if well founded, the content will be removed.

8. Free service and availability:

Music Pocket is offered free of charge and involves no subscriptions or in-app purchases.

The service is provided with no guarantee of continuity: it may be suspended for maintenance, updates or technical reasons, and individual features may be changed or discontinued.

We reserve the right to discontinue the service, giving reasonable notice where possible.

Some features depend on third-party services — the catalogue sources, Google sign-in, push notifications — and an outage of those services may affect the application.

9. Suspension and closure of the account:

You can delete your account at any time from within the application or by following the instructions on the account deletion page.

We may suspend or close an account in the event of a breach of these Terms, unlawful use of the service, or risk to other users or to our systems.

In less serious cases suspension is preceded by a warning, where circumstances allow.

10. Warranties and limitation of liability:

The service is provided "as is". We do not warrant that it will be free from errors or interruptions, nor the accuracy and completeness of catalogue data, which comes from external sources.

To the extent permitted by law, Estroverso Srl is not liable for indirect damages, loss of data or loss of profit arising from the use of, or inability to use, the application.

We are not liable for content published by users, nor for third-party services reachable through links within the application.

Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence, nor the rights granted to consumers by mandatory law.

11. Personal data:

The processing of personal data is described in the Music Pocket Privacy Policy, available inside the application and at https://musicpocket.app/legal/privacy.

How to delete your account and the data linked to it is described at https://musicpocket.app/legal/delete-account.

12. Changes to the Terms:

Estroverso Srl may amend these Terms, for example following changes to the service or to the applicable legislation.

Significant changes will be announced inside the application or through other appropriate means before they take effect.

Continuing to use the service after the changes take effect counts as acceptance; anyone who does not accept them can delete their account.

13. Governing law:

These Terms are governed by Italian law.

If you are a consumer, the rights granted to you by the law of the country where you live still apply.
